Yup. Bayh-Dole Act. Legalized payoffs. I remember first learning about this from an article that covered a time (about a decade ago?) when there was an effort to reform it, and both government employees and lobbyists MASSIVELY opposed it. The government said that without it, they couldn't hold on to scientists. And the lobbyists... well... it was a nice way to induce/bribe government employees legally, as the government employees would be named as co-developers of the patented materials/drugs, and receive a nice (or bigger) payout, if only the government employee helped them to get approval expeditiously. (ie, a thumb on the approval scale)

Yet another reason for the world to hate the US. Part of me says hey it’s not me! It’s the corrupt politicians and bureaucrats! Don’t hate me! But I do feel some responsibility for being SO UNAWARE as to how bad it is and how long this has been going on (and many, many even worse things they’ve been up to). Where to start to make things right?!

Before Bayh-Dole 100% went back to govt. The govt owned the product and licensed it The scientists get a small fraction now. Technically the NIH is govt, and govt is owned by us. Whatever NIH gets, means they use less tax dollars, in theory.

The biggest problem is COI, separating the regulators from the marketers/profiteers. There is no firewall.

I have wondered at times if this is one of the plays to create a new kind of tax base to run the government after the dollar fails. In fact, I think that the buildup of intellectual property war chests are part of that plan, generally.

You wouldn’t think an average of $12.000 a year would be enough to colour anyone’s judgement but the average hides a multitude of sins. How much are the largest payments to people who have power to influence events and how big are the Covid royalties from Moderna? They probably aren’t covered in this disclosure.

Army Corps researchers submit patents for many environmental contaminant treatment technologies and spin off technologies from that research. These payments are usually less than $100K per year and usually split across a team of researchers. The actual payment amount depends on income from the patent use. However, the Army lawyers do not always enforce royalty payments for use of the patents. Therefore, royalty payment are small and many times nonexistent.

It appears that NIH researchers get a much better deal and that pharma is happy to pay for free research provided by the US taxpayer. Plus there must be a good after retirement job waiting at a pharma company.

So, a scientist paid (ostensibly) with tax dollars and working for the government, also receives royalties from a pharma product he develops, if it is successfully sold by private pharmaceutical firms. What's the worst that could happen? (Note, if the government mandates that product, then they have effectively required the sale of that product! Nice racket.)
